NJ CLE Requirements at a Glance

Every two years by December 31, New Jersey attorneys are required to complete 24 hours of Continuing Legal Education, The amendments to Rule 1:42 and applicable CLE Regulations increase the total credit hours required for professionalism and ethics from four to five credits (of the overall total requirement of 24 credits per two-year reporting cycle) and require that at least two credit hours of those five credit hours in professionalism and ethics include the completion of qualifying coursework on diversity, inclusion, and elimination of bias. Of the 24 hour requirement, attorneys may take up to 12 hours of CLE credit through an approved alternative verifiable learning format.

Steven A. Nielsen objectively addresses progress made and new challenges faced by the legal profession in the areas of diversity and inclusion. This program includes a through review of multiple newly published articles and surveys, discernable trends, and valuable resources available. Topics include bullying as a form of gender discrimination, and ageism and mental health as other forms of perceived bias. He includes information on new programs that provide loan counseling and cross-cultural competency in ABA accredited law schools, the Diverse Lawyers Trial Academy which aims to further "first chair" opportunities for women, the Community Fund for Black Bar applicants and the AccessLex Center for Legal Education Excellence.

Mr. Nielsen reviews new data from the ABA on diversity and the need to promote minority associates. The objective of this presentation is to identify and discuss key legal and social issues in the context of today's volatile society, with an emphasis on limitations on the use of force and legal remedies in response to police misconduct. The presenter discusses how current events give rise to cases in numerous legal areas, from Civil Rights violations, Constitutional Law, including freedom of speech and lawful (and unlawful) protests, and liability for damages from both protests and police misconduct. Moreover, the presenter discusses topical issues of vital importance, such as the ?defund? movement, which runs along a spectrum, from those in Minneapolis who would disband and rebuild their police department (on the theory that the current department?s culture is too pervaded by racism and violence), to those in New York City or Los Angeles who advocate reallocation of spending and reform of police practices. Ultimately these issues end up in Court, where lawyers must be leaders and help society solve these complicated issues. This program aims to increase awareness of the critical legal issues involved.

Detailed NJ CLE Requirements

What are the general New Jersey CLE Rules?

Attorneys holding a license to practice in New Jersey shall participate in twenty-four hours of qualifying continuing legal education over a two-year period. Four of the twenty-four hours of credit shall be concentrated in the areas of ethics and/or professionalism. Attorneys shall demonstrate that they have satisfied the continuing legal education requirement by certifying to their compliance at the end of the two-year period in a manner prescribed by the Board on Continuing Legal Education. In addition, attorneys shall maintain all necessary records and documentation to demonstrate such compliance in accordance with regulations adopted under these Rules.

Courses taken through approved alternative verifiable learning formats, shall account for no more than twelve credit hours per compliance period.

Each active lawyer is permanently assigned to one of two compliance groups for CLE purposes, with one group reporting each year. Those whose birthdays are during the period from January 1 through June 30 must certify their compliance on the Annual Attorney Registration Statement (or on such other form as provided by the Board) of each even numbered year next following the completion of a compliance period (Compliance Group 1); those whose birthdays are during the period from July 1 to December 31 must certify their compliance on the Annual Attorney Registration Statement (or on such other form as provided by the Board) of each odd numbered year next following the completion of a compliance period (Compliance Group 2).



What are the New Jersey CLE Carryover Credit Rules?

No more than a total of twelve credit hours may be carried over to a subsequent compliance period.

What are the New Jersey CLE Reporting Procedures?

Every lawyer subject to the mandatory requirements of BCLE Reg. 201:1 or 201:2 shall keep and maintain a record of CLE course attendance for a period of three years from the date of attendance, regardless of the person, entity, organization or association that offered the CLE course or the format in which the CLE course was offered.

At the end of each compliance period and subject to the provisions of BCLE Reg. 401:2, every lawyer subject to the mandatory requirements of BCLE Reg. 201:1 or 201:2 shall certify to the Board, as provided under Rule 1:4-4(b) and on the Annual Attorney Registration Statement (or on such other form as provided by the Board), the lawyer?s compliance with the mandatory requirements of BCLE Reg. 201:1 or 201:2. The Board retains the right to audit any lawyer?s compliance with the mandatory requirements of BCLE Reg. 201:1 or 201:2.

Every lawyer subject to the mandatory requirements of BCLE Reg. 201:1 or 201:2 shall cooperate in any such audit and shall reply in writing within thirty days of receipt of a request for information, producing proof of compliance. Where a lawyer is unable to provide to the Board the requested information in writing within thirty days, the lawyer shall, within that time, inform the Board in writing of the reason that the information cannot be so provided and shall give a date certain when it will be provided. A failure to cooperate under BCLE Reg. 401 may qualify as a violation of RPC 8.1(b). Lawyers, at the discretion of the Board, may also be assessed certain fees to assist in the funding of the continuing legal education program.
